EULA – End‑User License Agreement

1.2 License

Dialsoft LLC grants you a non‑exclusive, non‑transferable, revocable licence to use the Software solely for personal, non‑commercial purposes on devices you own or control, and only in connection with the official T4C Services.

1.2a Consent to Data Processing

By installing or using the Software, you expressly consent to the collection and processing of technical and behavioral data (hardware identifiers, MAC address, running processes, security telemetry) for anti-cheat and security purposes. If you do not agree, you must not install or use the Software. You may withdraw consent by uninstalling the Software.

1.3 Restrictions

You may NOT:

  • Copy, distribute, lease, lend, sell or sub‑license the Software;
  • Modify, decompile, reverse‑engineer, create derivative works or tamper with the Software, Launcher, Game or Anti‑Cheat System;
  • Use any third‑party cheat, macro, bot, trainer or software that alters normal operation;
  • Interfere with, block or prevent the Launcher from downloading the anti‑cheat block‑list or communicating with official T4C servers;
  • Run the Software on unofficial hosts (private servers, VPNs hiding the official host);
  • Conceal, falsify or manipulate data collected by the Launcher (IP, MAC, hardware ID, PC name, processes).

1.3a Anti-Cheat Enforcement

The Software may monitor running processes and may terminate unauthorized or prohibited software that interferes with the integrity of the Services.

1.4 Ownership

All rights, title and interest in and to the Software, the Launcher, the Game, the underlying source code, artwork, trademarks and any other intellectual‑property assets remain the exclusive property of Dialsoft LLC and its licensors. No ownership is transferred to you.

1.5 Third‑Party Components

Some components (Google Analytics, reCAPTCHA) are included and governed by their own licences (incorporated by reference).

1.6 Termination

The licence terminates automatically and without notice if you breach this Agreement, the TOS or the Privacy Policy. Upon termination:

  • You must cease all use of the Software and uninstall it from every device;
  • You will be denied access to the Services, the Launcher and any game servers;
  • No refunds will be provided for any purchases made prior to termination;
  • Dialsoft may retain minimal data needed for enforcement, fraud prevention or legal compliance.

1.7 Limited Warranty

Limited Warranty – The Software is provided “as is” without any express or implied warranties, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. Dialsoft does not warrant uninterrupted or error‑free operation. In no event shall Dialsoft’s liability for any claim exceed the amount you have paid for the Software.

1.8 Disclaimer of Liability

To the fullest extent permitted by applicable law, Dialsoft shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or use, arising out of or related to this Agreement, the Software or the Services, even if Dialsoft has been advised of the possibility of such damages.

1.9 Indemnification

You agree to indemnify, defend and hold harmless Dialsoft, its affiliates, officers, directors, employees and agents from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of your breach of this Agreement or any violation of law or third‑party rights.

1.10 Governing Law & Jurisdiction

This Agreement shall be governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles. Exclusive jurisdiction and venue shall be in the state or federal courts located in New Jersey.

Terms of Service (TOS)

2.1 Acceptance

Using the Launcher or Services means you accept the Terms, the EULA and the Privacy Policy.

2.2 Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction).

2.3 Account Registration & Security

  • Provide accurate information – a valid e‑mail address and a unique username.
  • You are responsible for every action performed under your Account, including actions taken by anyone you permit to use your credentials.
  • Use a strong password, keep it confidential and notify us immediately of any unauthorized use.

2.4 Use of the Services

  • Personal, non‑commercial use only.
  • Access only through the official Launcher; any modified or unofficial client is prohibited.
  • The Launcher downloads a block‑list of cheating programs and terminates any matching process. You must not interfere with this mechanism.

2.5 Code of Conduct (Dialsoft)

Communication – respectful, no hate speech, vulgarity, threats or harassment.
Naming – character, pet, guild names must be appropriate.
Cheating – any third‑party software giving an unfair advantage is prohibited.
Exploitation / Scams – no account‑sharing, scams or any activity that degrades other players’ experience.
Behavior – no griefing, feeding, intentional sabotage.
Reporting – report genuine violations; false reports are punishable.

2.6 Payments, Purchases & Refunds

In‑game purchases are non‑refundable unless required by law. If your Account is terminated for a breach, any remaining credit, virtual currency or subscription time is forfeited; no refunds will be issued.

2.7 Suspension & Termination

Violations can result in temporary suspension or permanent termination of your Account and access to the Services. After termination you must uninstall the Software immediately.

2.8 Intellectual Property

All content, trademarks, logos, artwork and software related to T4C are the exclusive property of Dialsoft LLC or its licensors. No reproduction, distribution or creation of derivative works is allowed without explicit written permission.

2.9 Data Processing

Your personal data is processed according to the Privacy Policy.

2.10 Disclaimer & Limitation of Liability

The Services are provided “as is” and “as available”. The warranty disclaimer and limitation of liability are set out in the EULA (§ 1.7‑1.8).

2.11 Changes to the Terms

Dialsoft may amend these Terms at any time. Continued use after a change constitutes acceptance of the revised Terms. Significant changes will be posted on the official website or communicated by e‑mail.

2.12 Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the State of New Jersey, United States. Disputes shall be resolved in the state or federal courts located in New Jersey, unless mandatory local consumer-protection laws require otherwise.

Privacy Policy

3.1 Overview

Dialsoft LLC (“Dialsoft”, “we”, “our”) operates the T4C game, its launcher, website and related services (the “Services”). This policy explains what personal data we collect, why we collect it, how we use it, who we share it with, how long we retain it, your rights and our security measures, in compliance with applicable data‑protection laws (including the GDPR).

3.3 Personal Data Collected

  • Account & identification – username, e‑mail, password hash, character names, purchase history, support tickets.
  • Technical / device – IP address, MAC address, computer name, hardware IDs (CPU/GPU serial numbers, hardware‑ID), OS version, drivers, running processes, block‑list of cheat programs, process‑termination actions.
  • Gameplay – in‑game actions, scores, chat logs (only when reported).
  • Analytics & cookies – browser type/version, language, device type, referrer URL, analytics IDs.
  • Payment – transaction IDs, payment references (handled by third‑party processors).

3.4 How We Collect

  • Directly – via forms, account creation, support requests, purchases, launcher start‑up.
  • Automatically – via the launcher, Anti‑Cheat System, cookies, analytics tools.
  • From third parties – payment processors, social‑media plugins, analytics providers.

3.5 Purposes of Processing

  • Provide & secure the Service.
  • Anti‑cheat detection.
  • Account management & authentication.
  • Customer support.
  • Billing & payments.
  • Communications & marketing (with consent).
  • Analytics & service improvement.

3.6 Legal Bases (GDPR Art. 6)

  • Legitimate interests – anti‑cheat, fraud prevention, security.
  • Contract performance – service delivery, payments.
  • Consent – marketing.
  • Legal obligation – law‑enforcement requests.

3.6a Legal Basis for Anti-Cheat Processing

We process certain personal data (hardware identifiers, MAC address, running processes, security telemetry) on the basis of our legitimate interest (Article 6(1)(f) GDPR).

3.6b Data Protection Impact Assessment (DPIA)

Due to the intrusive nature of anti-cheat monitoring, we may conduct a Data Protection Impact Assessment (DPIA) and implement technical and organizational measures to protect privacy.

3.7 Recipients & International Transfers

  • Internal – Dialsoft staff (security, support, management).
  • External – payment processors, cloud‑hosting providers, analytics services (Google, WordPress, etc.).
  • Transfers outside the EU (mainly to the United States) are protected by EU‑Standard Contractual Clauses.

3.8 Retention Periods

  • Account data – until deletion or > 24 months inactivity.
  • Anti‑cheat logs – for the duration of the service + 5 years for enforcement.
  • Payment data – minimum 5 years (tax compliance).
  • Cookies & analytics – session cookies until the browser is closed; persistent cookies up to 2 years.
  • Support tickets – 2 years after closure.

3.9 Your Rights (EU Residents)

You have the right to: access, rectify, erase, restrict processing, object, obtain data portability, withdraw consent and lodge a complaint with a supervisory authority. To exercise any of these rights, contact compliance@t4c.com. We will respond within 30 days.

3.10 Security Measures

TLS/SSL encryption, BCrypt password hashing, encrypted storage of sensitive data, regular security audits and penetration testing. No system can guarantee absolute protection; you must also safeguard your credentials.

3.11 Children’s Privacy

The Services are not intended for children under 13. We do not knowingly collect personal data from children; any inadvertently collected data will be deleted immediately.

3.12 Communications & Marketing

We may use certain personal data (email address, account ID, purchase history, user preferences) to send you:

  • information about game updates and new features;
  • invitations to in-game events, contests, and community programs;
  • promotional offers and commercial communications;
  • newsletters.

These communications are sent only:

  • with your explicit consent (opt-in);
  • or, where legally allowed, as part of an existing commercial relationship for similar services.

You can withdraw your consent at any time via the unsubscribe link in each email, through your account settings, or by contacting compliance@t4c.com.

3.12a Legal Basis for Marketing

  • Consent (Article 6(1)(a) GDPR).
  • Legitimate interest for existing customers (Article 6(1)(f) GDPR), where permitted by law.

3.12b Marketing Profiling

We may analyze certain data (purchase history, in-game activity, technical and language preferences) to personalize marketing communications. This processing does not produce any legal or significant automated effects. You may object at any time.

3.12c Marketing Data Sharing

We may share certain data with marketing service providers acting as processors (email platforms, analytics tools, advertising platforms). These providers are contractually required to comply with GDPR.

3.12d Marketing Data Retention

Marketing data is retained until consent is withdrawn or for a maximum of 3 years after the last active interaction with our communications, unless legal obligations require otherwise.

3.12e Right to Object to Marketing

You have the right to object at any time to the processing of your data for direct marketing purposes. Any request can be sent to compliance@t4c.com and will be processed within 30 days.

3.13 Changes to This Policy

We may update this policy at any time. The “Effective Date” reflects the latest version. Material changes will be posted on the website and, where appropriate, communicated by e‑mail.
